Is DUI Law specific to each state or each county?
The DUI laws at Florida are a state-statute. It is 316.193 of the Florida Statute. That Statute controls DUI laws in all counties in Florida.
So whether you’re in Miami or you’re in Pensacola, the same statute would apply. And it’s basically broken down into two separate types of criminal offense DUIs. You have a misdemeanor DUI which is handled in the county court of county in which you are arrested. And there’s also Circuit Court which would handle all felony DUIs.
