There are two basic areas of DUI law. First is going to be the Department of Highways Safety and Motor Vehicles which is basically Florida’s version of the DMV. That is normally handled first because you only have 10 days from the date of your arrest. And that 10 days is calendar days.
In other words, just because it falls on a holiday or weekend, you get extra time. It doesn’t work that way. It is 10 calendar days. Now if the 10th day happens to fall on a weekend they will give you to the next business day available.
But you have to be very aggressive with handling that portion of the case. That is the key, is making sure you can legally drive. And the only way you can find that out and get that done is getting that done within 10 days from the date of your arrest.
